These are the terms of use and privacy policy for http://www.heliumfinance.co.uk. The website is operated by Nuvem9 Ltd. For the purposes of the Data Protection Act 1998, and the General Data Protection Regulations 2018 (as applicable), through your use of this website, we become in possession of your data, and thereby the data controller.

We are committed to protecting your privacy online. We appreciate that you do not want the personal information you provide to us distributed indiscriminately and this privacy policy explains how we collect information, what we do with it and what controls you have.

By using the website as a prospective or registered borrower, you consent to the collection and use of information in accordance with this privacy policy.

We reserve the right to change this privacy policy from time to time by changing it on the website. This privacy policy was last updated on 1st October 2019.

General Company Terms

  1. Helium will require data from your Company, your Directors and your majority shareholders to support any finance application. We will only use this data for the purposes of supporting finance applications. The data will normally comprise bank statements, management accounts, statutory accounts, vat returns, Director date of birth and residential addresses. Depending on the lender’s review there may be additional information requested but we will endeavour to ensure the majority of the requirements are covered in the advisory meeting.
  2. Helium use a broker and series of lenders that can enable direct integration to certain accounting packages. We may therefore request a user on the your accounting system. This will be for supporting the loan application and we will ensure that no underlying data is added, amended or deleted on the accounting system. We also recommend this user is removed once the finance applications are completed.
  3. By agreeing to these terms and conditions you are appointing Helium to speak to lenders on behalf of your Company. Helium will share the data you have provided with the lenders and use it to filter the most appropriate lender for your needs and company structure.
  4. Helium will never agree to a loan or commit you to repayments without your permission. All proposals that Helium identify on your behalf will be provided to you on a struct no obligation basis.
  5. Helium will never sign terms with any lender under any circumstances. If you decide to proceed with an offer made by a lender, Helium will put you in direct contact at which stage you will sign the contract and guarantees.
  6. Helium will advise you on what each offer means, how much they will cost and the relative advantages and disadvantages of one product versus an other. We will endeavour to ensure that the information collected at the advisory meeting means we can best find the product to suit your company needs and within affordability constraints. Helium cannot, and will not, tell you to proceed with a loan outside of this advice. That decision must rest with the Directors of the business; Helium’s role is to ensure you are best placed to make that decision.
  7. Helium cannot provide a guarantee any loan under any circumstances, nor be held responsible for any default on lending it facilitates.
  8. Helium will never seek funding for a Company that cannot demonstrably afford the repayments, nor that has a history of default with other lenders. The Companies we work with seek funding for growth, rationalisation of existing facilities or short term seasonal working capital needs.
  9. Helium will earn a commission from the lender and we will provide details of this on request. Helium will never recommend you proceed with one product over another based on Helium’s potential earnings.
  10. Helium is a trading name of Nuvem9 Ltd. Nuvem9 Lts is a Practicing Member of Chartered Accountants Ireland.

Information we may collect from you

We may collect and process the following information about you and your business:

  • information (such as your name, email address, postal address, telephone number and financial information about your business) that you provide or make available to us:
  • by completing forms on the website, including if you register with the website as a borrower or if you subscribe to any of our services;
  • by uploading or submitting any material via the website;
  • using a third party service or third party application (such as Xero or Quickbooks) to import data to the website or otherwise share your information with us;
  • in connection with an account sign-in facility, your log-in and password details;
  • details of any transactions made by you via the website or as a result of the service provided via the website;
  • communications you send to us, for example to report a problem or to submit queries, concerns or comments regarding the website or our services.

You are under no obligation to provide any such information. However, if you should choose to withhold requested information, we may not be able to provide you with certain services.

Information sharing

We will share details relating to borrowers to lenders who have registered with us to enable the lenders to assess the borrower’s suitability for a financial product offered by them, and all borrowers who sign up to the website consent to such.

We may disclose aggregate statistics about visitors to the website in order to describe our services to reputable third parties and for other lawful purposes, but these statistics will include no personally identifiable information.

We may disclose the information you submit via the website to our affiliates, or to our agents or contractors solely to allow them to assist us in providing the services we offer through the website, fulfilling requests for information, receiving and sending communications, updating marketing lists, analysing data, providing support services or in other tasks, from time to time. Our agents and contractors will only use your information to the extent necessary to perform their functions.

In the event that we undergo re-organisation or are sold to a third party, you agree that any personal information we hold about you may be transferred to that re-organised entity or third party.
